Sale of land for rates arrears
Council can recover outstanding rates on properties that are more than three years in arrears.
The provisions within the Local Government Regulation 2012 (sections 138 to 147) empower Council to conduct Sale of Land processes to recover unpaid rates for:
- Residential properties with rates or charges outstanding for three years or more.
- Vacant and commercial land with rates or charge outstanding for one year or more where judgment has been obtained.
These proceedings are generally held each year, in line with the Local Government Act 2009 and Local Government Regulation 2012.
Auctions are generally held in October each year. A list of properties included in the Sale of Land process is published before the auction (should one be required) as below.
- Council Offices, Council Website and in a conspicuous place on the property, four weeks prior to the auction, and
- Published in a newspaper that is circulating generally in the local government area, two weeks prior to the auction.
